TERMS OF USE THIS AGREEMENT CONSTITUTES A BINDING CONTRACT ON YOU AND GOVERNS USE OF AND ACCESS TO THE SERVICES BY YOU, AGENTS AND END-USERS WHETHER IN CONNECTION WITH A PAID OR FREE TRIAL SUBSCRIPTION TO THE SERVICES.
The reference to Certinext, Cryptas, eMudhra includes the respective entities Certinext Inc, USA and its subsidiaries or affiliates, Cryptas GmbH, Austria and its subsidiaries or affiliates, eMudhra Ltd, India and its subsidiaries or affiliates (collectively referred as "our entities"). Affiliate, with respect to any entity, means any corporation, partnership, or other legal person that is under common control with such entity, where "control" shall be deemed to exist through the direct or indirect ownership of more than twenty percent (20%) of the voting securities or voting interests, or the right to direct the management and policies of such entity.
The Site and/or Website referred in this Terms of Use includes all websites including mobile applications owned and operated our entities and/or its subsidiaries and affiliates from time to time.
By accepting this Agreement, either by accessing or using our entities' websites, products or services (individually, "Service" and collectively, "Services"), or authorizing or permitting any Agent or End-User to access or use a Service, you agree to be bound by this Agreement. If You are entering into this Agreement on behalf of a company, organization or another legal entity (an "Entity"), You are agreeing to this Agreement for that Entity and representing to eMudhra that You have the authority to bind such Entity and its Affiliates to this Agreement, in which case the terms "Subscriber," "You," "Your" or a related capitalized term herein shall refer to such Entity and its Affiliates. If You do not have such authority, or if You do not agree with this Agreement, You must not accept this Agreement and may not use any of the Services.
If you are a customer and you or your organization is bound by a Master Services Agreement and/or a Product License Agreement (individually or collectively, "Agreement") with our entities, then these Terms will prevail only to the use of the Site or any of our entities' services to the extent such use is not already governed by such Agreement.
By accessing and using our entities' services, you accept and agree to be bound by these Terms, Privacy Policy, Cookie Policy, End User License, Disclaimer and Governance. If you do not agree to these Terms, you should not access or use our entities' Services. In addition, when accessing or using the Services you shall be subject to any posted guidelines or rules applicable to the Services, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into these Terms.
We reserve the right to add to or change/modify the terms of this Agreement including but not limited to suspend/cancel, or discontinue any or all service at any time without notice, make modifications and alterations in any or all of the content, products and services contained on the site without prior notice. You are responsible for regularly reviewing these Terms of Use so that you will be apprised of any changes. You will be deemed to have accepted such change/s if you continue to access the Site subsequent to such changes.
In case of changes in rules and regulations & procedures we would try our best to incorporate the same into our services at the earliest however we do not take responsibility to always update our web site or the service/s offered instantly, at times it may take time or we may not consider to update the same for a reason; the decision of "our entities" in that regard would be final.
You agree to receive electronically all communications, agreements, and notices that we provide in connection with any eMudhra Service ("Communications"), including by e-mail, text, in-app notifications, or by posting them on the Site or through any of our entities Services. You agree that all Communications that we provide to you electronically satisfy any legal requirement that such Communications be in writing and you agree to keep your Account contact information updated.
